In short how are court forums set up, and people invited to them?

If it is about the Private Courts subforum, the GM team can create one for you and assign the access as per your direction. It is likely best you ask in Private Domain forum and lay out who has general access and if there should be a private little niche where only certain specified people have access to.

Sub forums can only be created by me. I create sub forums when requested.
There are two different ways of restricting access to sub forums:
1) The person who requested the forum ask via pm or post to have members added or removed from the sub forum. (usually via threads named: "OOC: Access to this board")
2) The person who requested the forum is granted leadership of a member group with access to the sub forum. The person can then add members to the group thus granting them access to the sub forum.
Most sub forums use method 1(All but a hibernian war sub forum managed by SWT).

And on that note, it can be cumbersome to start a subforum that is only closed to one or two parties.
